PREAMBLE:

 

Greyb4ck, with its registered office located at 2 Rue Roumanille, 13008 Marseille, and registered with the Marseille Trade and Companies Register under number 939 226 866, conducts a distance retail sale of Trading Card Game (TCG) products through its e-commerce website www.greyb4ck.com, pursuant to the distribution licenses received from its suppliers.

The Website www.greyb4ck.com (hereinafter referred to as the Website) provides Users and Buyers (hereinafter referred to as the User(s) or Buyer(s)) with information about Products, as well as an online ordering and payment system, subject to Users' compliance with these general terms and conditions. Any order placed through the Website implies consultation and express acceptance of these general terms and conditions of sale. Any order that appears to be a purchase made for professional purposes or for the purpose of resale will be considered null and void.

The Greyb4ck Company may be referred to herein by the abbreviation "Greyb4ck" or "The Company."

Prior to any order, any person browsing the website will be referred to hereinafter as the "User."

Any person who has accepted an order by confirming payment will be referred to hereinafter as the "Buyer."

The website www.greyb4ck.com will be referred to by the abbreviation "greyb4ck.com," "The Site," or "The Seller."

The General Terms and Conditions of Sale will be referred to by the abbreviation "GTC."

Article 1: Purpose

 

The purpose of these general terms and conditions of sale is:

- to inform the User of the terms and conditions under which Greyb4ck sells selective TCG (Collectible Card Game) or TCG (Trading Card Game) products.

- to define the relationships established on the Site,

- to define the rights and obligations of the Company operating the Site, as well as those of the User, arising from the online sale of the Products offered on the Site.

These general terms and conditions apply to the exclusion of any other document.

 

Any order placed through the Website implies consultation and express acceptance, without reservation or restriction, of these General Terms and Conditions.

Greyb4ck reserves the right to modify these general terms and conditions of sale at any time, in particular to bring them into compliance with applicable legal provisions.

 

However, the general terms and conditions of sale applicable when an order is placed are those in effect at the time the user places the order.

 

Article 2: Characteristics and Content of the Offer

 

2.1. Characteristics of the Products Sold Greyb4ck sources its products from these suppliers.

 

Greyb4ck reserves the right, at any time, to add new Products, remove all or part of the Products sold or presented on the Site, change their presentation, or discontinue their sale on its Site, without being required to notify the User in advance.

The user may purchase one or more products listed on the website for private and personal use only.

​

The website provides the user with the essential characteristics of the product(s), which the user may consult before purchase.

Greyb4ck cannot guarantee that the information on product packaging or described in the product sheets is translated into foreign languages. The information provided is available in French.

For any questions regarding the products and their use, or to request advice, the Buyer may contact the dedicated JCC/TCG Customer Service by email at greyb4ck@gmail.com or by calling +33 6 36 14 19 47 from France, during the service opening hours indicated in the "Contact Us" section of the Website.

Greyb4ck undertakes to comply with all provisions relating to the safety of JCC/TCG products.

2.2 Product Authenticity - Legislation

​

Greyb4ck only distributes authentic products on its website, in compliance with current French and European legislation and standards.

It cannot be held liable for non-compliance with the legislation of the country to which the product will be delivered. It is the user's responsibility to check with the local authorities of the country of delivery regarding the import or use of the products and services they plan to order.

2.3 Product Prices

2.3.1. Determination of the Final Sale Price

​

The online product sales prices on the Website www.greyb4ck.com applicable to distance selling are indicated in euros, inclusive of all taxes, and are those in effect at the time the User places the Order. The product sales prices may be modified by Greyb4ck at any time without prejudice to the amount stipulated when ordering.

These prices do not include delivery costs, which are invoiced in addition to the price of the products purchased. Shipping costs are indicated before the Buyer places the Order. The various shipping methods are set out below in the General Terms and Conditions and are listed on the Website; they may be modified at any time by Greyb4ck.

2.3.2. Determination of the Displayed Reference Price

​

The reference price of a product listed in the Greyb4ck website catalog consists of the unit purchase price excluding VAT, adjusted by a variable markup coefficient and including the value-added tax applicable in France. (not at the moment)

2.4 Product Availability

​

Product availability is communicated to the User while browsing the website using three indicators: in stock, being restocked, or unavailable.

Product availability is communicated to the Buyer when placing their Order, in the shopping cart summary. Greyb4ck undertakes to use all means to fulfill the order as quickly as possible.

Article 3. Order

3.1. Navigation

​

The User may freely browse the various pages of the website without being bound by an order.

​

​

3.2. Placing an Order

​

Any Order implies acceptance of these General Terms and Conditions of Sale and the provisions relating to the use of cookies, without prejudice to any specific contractual terms and conditions entered into between the Parties.

The Buyer may, at any time, check the details of their order and modify its content before confirming payment.

Once payment has been confirmed:

- The Buyer acknowledges having knowingly accepted the content and conditions of the submitted Order, and in particular these General Terms and Conditions of Sale.

- The Buyer acknowledges the payment obligation resulting from their order, as well as the prices, volumes, characteristics, quantities, and delivery times of the products offered for sale and ordered by them.

Once this step has been validated, the sale is considered final, subject to the Buyer exercising their right of withdrawal under the conditions set out in Article 6 of these General Terms and Conditions of Sale.

This Order is confirmed by Greyb4ck by sending an email to the Buyer (the "Order Confirmation Email").

All emails are sent to the email address entered by the Buyer upon registration and identification, prior to placing the Order.

Greyb4ck is entitled to collect the full price corresponding to the Order:

- With regard to payments made by other payment methods accepted on the Website in accordance with Article 4.1 below: upon sending the email confirming the order placed by the Buyer.

Furthermore, in the event of an error in entering the email address concerned, or failure to receive the Order confirmation email, Greyb4ck shall not be held liable. In this case, the sale will be considered final, except in cases of cancellation of the Order by Greyb4ck. The Buyer may nevertheless exercise their right of withdrawal under the conditions set out in Article 6 of these General Terms and Conditions of Sale.

3.4. Final Confirmation of the Order:

After reviewing the status of their order, and once all information has been completed by the User, the latter confirms their payment via Stripe or Paypal. The order is then registered and becomes irrevocable, notwithstanding the exercise of the right of withdrawal as provided for in Articles L et seq. of the French Consumer Code.

The User then becomes the Buyer. The automatic registration systems of the website www.greyb4ck.com are considered proof of the content of the order and its date.

3.5. Order Confirmation:

​

When the Buyer has validated their payment, a summary of the Buyer's order is displayed, including the transaction number. Within 24 business hours of the order being registered, the Buyer will receive an acknowledgment of receipt by email. If this document is not received within the specified timeframe, it is the Buyer's responsibility to contact the Company, as the order may not have been registered for technical reasons. If the order acknowledgment cannot be delivered to the provided email address, the order will be canceled. The order will only be considered firm and final after confirmation by the Company.

3.6. Order Modification:

Any modification to the order requested by the Buyer can only be considered if it is received by Greyb4ck by email before the Products are shipped.

3.7. Order Cancellation:

3.7.1 Order Cancellation by Greyb4ck

3.7.1.1 Cancellation for Payment Incident or Fraud

​

Greyb4ck reserves the right to suspend or cancel any Order execution and/or delivery, regardless of its nature, at any time during the ordering process, in the event of non-payment or partial payment of any amount due by the Buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Website www.greyb4ck.com, including in connection with previous Orders.

3.7.2. Cancellation and Right of Withdrawal by the Buyer

Refer to Article 6 of these General Terms and Conditions.

Article 4 – Payment

4.1 Payment Methods

​

The Buyer may use the following payment methods:

Bank Card via Stripe or PayPal

The Buyer guarantees to Greyb4ck that they have the necessary authorization to use the payment method they have chosen for their Order when registering the Order.

4.1.1 Bank Cards

​

The following bank cards are accepted on the greyb4ck.com Website: Carte Bleue, Carte Bleue Visa.

​

​

4.1.4 PayPal

​

The Buyer may use their PayPal account to pay for orders on the Website.

​

​

4.1.5 Online Credits

​

Online credits are issued exclusively by greyb4ck.com and can be used by their recipient only on the greyb4ck.com Website. They are valid for 1 year from their date of issue.

​

4.1.6 Gift Certificates

greyb4ck.com does not accept payment by gift certificate.

​

​

4.2. Payment Methods

​

Payment is made by the Buyer when placing an online Order using the payment methods offered on the website. In case of difficulty, the Buyer may contact greyb4ck.com Customer Service from France or abroad during the service opening hours indicated in the "Contact Us" section of the greyb4ck.com website by calling +33 6 36 14 19 47.

All Orders are payable in euros, including all taxes and mandatory contributions. Greyb4ck cannot be held responsible for any taxes that may be due on orders placed by Buyers residing outside the EU or for sea dues. Any bank charges remain the responsibility of the Buyer (including in the case of a refund).

Penalties equal to the legal interest rate may, at the discretion of greyb4ck.com, be automatically applied to unpaid amounts after a period of ten days following the date of notification of a bank payment rejection.

​

4.3 Security in Payment Transactions

​

To ensure the security of credit card payments, the Buyer must provide greyb4ck.com with the security code (CVV) on the back of the bank card used by the Buyer.

​

As part of the fight against online fraud, information relating to the Buyer's Order is transmitted to any third party authorized by law or clearly designated by greyb4ck.com for the purpose of verifying the Buyer's identity, the validity of the Order, the payment method used, and the intended delivery.

Le porteur doit donc être en possession du terminal téléphonique lui permettant de récupérer le code reçu.
Ce procédé est destiné à permettre une protection renforcée contre l’usage de la carte bancaire du client.

Article 5 - Livraison et Réception de commandes

5.1 Lieux de Livraison

​

Les produits commandés par l'Acheteur conformément aux présentes CGV seront livrés à l'adresse indiquée par l'Acheteur comme adresse de livraison sur la Commande concernée (« Adresse de livraison »).

greyb4ck.com met à disposition de l’acheteur les solutions de livraison suivantes :
- à domicile ou à l’adresse de livraison figurant sur la commande,  

greyb4ck.com livre tous les pays de l'Union Européenne, hors Italie et livre également à Monaco. Les territoires du Moyen-Orient, de l’Afrique, et de l’Asie ne sont pas desservis.

Les factures d'achat sont adressées par courrier électronique à l'adresse de messagerie électronique indiquée par l'Acheteur lors de son inscription sur le Site greyb4ck.com.
 

5.2 Modes de livraison

Greyb4ck ne remet aucun colis à son transporteur les jours suivants : samedi - dimanche - jours fériés du fait qu'aucun service n'est assuré ce jour-là.

5.2.1 Modes de livraison pour la France Métropolitaine, la Corse et Monaco
               
5.2.1.1. Livraison Colissimo

Le colis comportant les produits commandés et payés est distribué à l'Adresse de Livraison.

Dans le cas où la boîte aux lettres de l’adresse de livraison est de taille insuffisante, le colis est livré à domicile et remis soit à l'Acheteur ou au destinataire de la Commande, soit, à la discrétion de La Poste, à une autre personne, notamment toute personne attachée à son service, demeurant avec lui, mandatée spécialement, munie d'une procuration ou encore à un tiers identifié.

Lorsque le colis n'a pu être livré pour les raisons citées précédemment (taille insuffisante de la boîte aux lettres et/ou absence du destinataire), l'Acheteur ou le destinataire de la Commande reçoit un avis de passage, lui permettant de retirer le colis au bureau de Poste indiqué dans l'avis de passage, pendant un délai de 14 jours.

Passé ce délai, le colis est retourné à l'expéditeur. Dans ce cas, l'Acheteur est remboursé du montant de la Commande, frais de livraison déduits, par tout moyen, au choix de greyb4ck.com.


5.2.1.3 Livraison en Point Relais So Colissimo

Le colis comportant les produits commandés et payés est déposé au Point Relais So Colissimo sélectionné par l'Acheteur lors de sa Commande. 

L'Acheteur de la Commande reçoit un email lui permettant de retirer le colis au Point Relais indiqué dans l'email pendant un délai de 15 jours à compter de la réception de l'email de greyb4ck.com. Le retrait en Point Relais n'est possible que sur présentation de l'email susvisé et de la pièce d'identité de l'Acheteur.

Passé ce délai, le colis est retourné à l'expéditeur. Dans ce cas, l'Acheteur est remboursé du montant de la Commande, frais de livraison déduits, par tout moyen, au choix de greyb4ck.com.

Aucune contestation relative à la livraison en elle-même n'est possible si le colis apparaît comme ayant été livré, le registre du Point Relais faisant foi.

5.2.2 Modes de livraison à l’étranger
 

5.2.2.1 Livraison par Colissimo International

Les modalités de livraison sont adossées au réseau Colissimo International et dépendent des services postaux locaux. Elles diffèrent donc d'un pays à l'autre.
Toutefois,  un bordereau de distribution ou un accusé de réception devra être signé par l'Acheteur ou le destinataire de la Commande lors de la remise du colis et vaut preuve de la livraison par greyb4ck.com et de la réception par l'Acheteur ou le destinataire de la Commande, des produits commandés.

En cas d'absence de l'Acheteur ou du destinataire de la Commande, l'Acheteur ou le destinataire de la Commande reçoit habituellement un avis de passage, lui permettant de retirer le colis au bureau de poste indiqué dans l'avis de passage, pendant un délai de 10 à 21 jours. Cependant, les modalités de livraison variant d'un pays à l'autre, l'Acheteur est invité à consulter régulièrement le suivi de son colis, via le lien présent dans le courrier électronique informant l'Acheteur de l'expédition de sa Commande, pour obtenir les informations relatives à la livraison de sa Commande.

Dans le cas où le colis ne serait pas retiré dans un délai de 10 à 21 jours ouvrables à compter de la réception de l'avis de passage (ou à défaut de la première tentative de livraison du service postal local), le colis est retourné à greyb4ck.com et l'Acheteur remboursé, par tout moyen, au choix de greyb4ck.com, du montant de sa Commande, frais de livraison déduits.  

Aucune contestation relative à la livraison en elle-même n'est possible si le colis apparaît comme ayant été livré, le système de traçage informatique  du service postal local faisant foi.
 

5.3 Anomalie, avarie, colis endommagé

5.3.1 Dispositions générales 

L'Acheteur, ou le destinataire de la Commande est invité à vérifier l'état apparent du colis et des produits à la livraison.

5.3.1.1 Livraison par colissimo

En cas d'anomalie portant sur le colis (colis endommagé, colis ouvert, détérioration visible ou audible du contenu), l'Acheteur ou le destinataire de la Commande doit impérativement refuser le colis, faire établir un constat de spoliation auprès de la poste et signaler le refus auprès du Service Clients de greyb4ck.com dans les délais les plus brefs.

5.3.1.2 Livraison en Point-Relais So Colissimo ou Mondial Relay

En cas de livraison en Point-Relais So Colissimo ou Mondial Relay, ne pas accepter le colis. L'ouverture du colis exclut tout recours contre So Colissimo, Mondial Relay et greyb4ck.com. L’Acheteur ou le destinataire doit signaler le refus auprès du Service Clients de greyb4ck.com dans les délais les plus brefs.

​

5.3.1.3 Livraison par Colissimo International

Ne pas ouvrir le colis. Attention : l'ouverture du colis exclut tout recours contre le service postal local, ColiPoste et greyb4ck.com
Ramener le colis non ouvert au bureau de poste local dans les cinq jours ouvrables à compter de la livraison
Etablir un constat d'anomalie (la dénomination varie selon les pays)
Signaler l'anomalie auprès du Service Clients greyb4ck.com.
 

5.3.1.4 Retrait en Magasin 

Les produits faisant l’objet d’un retrait en point de vente physique sont mis à disposition de l’Acheteur de la même façon que s’il achetait en magasin. Les produits ne sont donc pas protégés pour le transport dont les risques restent à la charge de l’Acheteur. Les produits sont livrés dans un sac shopping au choix de greyb4ck.com. Lors du retrait de la commande, une pièce d'identité en cours de validité doit être présentée et correspondre à l'identité de la personne ayant passé commande. Si la personne ayant passé commande est dans l'incapacité de retirer sa commande, celle-ci doit mandater un proche, qui devra être en possession de la photocopie recto-verso de la pièce d'identité en cours de validité de l'émetteur de la commande, de sa propre pièce d'identité, ainsi que d'une procuration manuscrite, datée, et signée du mandant. 

Le retrait en magasin ne pourra être effectué qu'après la réception du mail informant que le produit est à disposition dans le point de vente physique. Aucune commande ne pourra être retirée avant réception de ce mail, et pour quelque raison que ce soit.   
 

5.3.2 Procédure devant impérativement être suivie en cas de produit manquant ou endommagé à l’intérieur du colis sans dommage visible de l’extérieur

L'Acheteur ou le destinataire de la Commande devra signaler l'absence ou la dégradation du produit auprès du Service Clients d'greyb4ck.com. Le Service Clients indiquera la procédure à suivre à l’aide d’une réponse personnalisée.
 

5.4 Délais de livraison

Les délais de livraison à destination de la France métropolitaine et de Monaco mentionnés s'appliquent aux produits en disponibilité immédiate et prennent en compte le délai de préparation des colis.

- So Colissimo : 2 à 4 jours ouvrés

Les délais de livraison pour les autres pays : 15 jours ouvrables.

Point de départ du délai de Livraison :

Les délais de livraison commencent à courir dès l'envoi du courrier électronique de confirmation de Commande.

En cas de dépassement de ces délais non dû à un cas de force majeure, l'Acheteur aura la possibilité d’annuler sa Commande dans les conditions suivantes :
- En contactant par tous moyens le service client Greyb4ck: dans la rubrique "Nous contacter" du Site greyb4ck.com ou par téléphone aux heures d’ouverture du service indiquées dans la rubrique "Nous contacter" du Site greyb4cket en exprimant sa volonté clairement et sans ambiguïté. Il conviendra alors de refuser le colis, si le colis a déjà été expédié.
 

Article 6 - Droit de Rétractation Légal
 

6.1. Exercice du Droit de rétractation légal

Le droit de rétractation peut être exercé conformément aux dispositions des articles L.221-5, L.221-18, L221-19, L.221-23 et L.221-24 du Code de la Consommation prévoyant les modalités de sa mise en œuvre.

6.1.1. Délai d'exercice du droit de rétractation légal 

Conformément aux dispositions de l'article L. 221-18 du Code de la Consommation français, l'Acheteur dispose d'un délai de 14 (quatorze) jours pour exercer son droit de rétractation légal sans avoir à motiver sa décision. 

Conformément aux dispositions de l’article L. 221-19 du Code de la Consommation français, et au règlement n° 1182/71/ CEE du Conseil du 3 juin 1971 portant détermination des règles applicables aux délais, aux dates et aux termes,  le délai court à compter du lendemain du jour de la réception du colis comportant les produits commandés. Si le délai expire un samedi, un dimanche, un jour ferié, ou chômé, il est prorogé jusqu’au premier jour ouvrable suivant.
 

6.1.2 Modalités d'exercice du droit de rétractation légal

Conformément aux dispositions de l'article L.221-21 du Code de la Consommation français, L'Acheteur exerce son droit de rétractation en informant le Vendeur de sa décision de se rétracter par l'envoi, avant l'expiration du délai prévu à l'article L.221-18, du formulaire de rétractation ou de toute autre déclaration, dénuée d'ambiguïté, exprimant sa volonté de se rétracter. 

Pour exercer son droit de rétractation légal, l'Acheteur peut notamment utiliser le modèle de formulaire de rétraction figurant en annexe des présentes Conditions Générales de Vente et l'envoyer à l'adresse suivante : 2 Rue Roumanille – 13008 Marseille, ou l'envoyer par courrier électronique à l'adresse suivante : greyb4ck@gmail.com. 

6.1.3. Produits exclus du droit de rétractation légal 

Conformément aux dispositions de l'article L.221-28 du code de la Consommation, le droit de rétractation ne peut être exercé pour les Commandes portant sur la fourniture de biens qui ont été descellés après la livraison et qui ne peuvent être renvoyés pour des raisons de impossibilité de revente. 

En conséquence l’Acheteur est alerté sur le fait, qu’il ne pourra pas faire valoir son droit de rétractation sur les produits descellés par ce dernier dont une nouvelle commercialisation par greyb4ck.com présenteraient des risques pour des raisons d’impossibilité de revente.

Ces dispositions s’appliquent sans préjudice des garanties prévues aux autres articles des présentes CGV qui demeurent pleinement applicables.

6.2. Modalités de Retour et de Remboursement au titre du Droit de rétractation légal

6.2.1 Délai de Remboursement 

Les produits faisant l'objet de l’exercice du droit de rétractation légal seront remboursés à l'Acheteur au plus tard dans les quatorze jours à compter de la date à laquelle Greyb4ck est informée de la décision du consommateur de se rétracter, et ce, dans le respect des conditions prévues à l’article L.221.24 du Code de la Consommation. Toutefois le remboursement est différé jusqu’à la récupération par le Vendeur desdits produits, ou lorsque l’acheteur aura apporté la preuve de l’expédition des biens, la date retenue étant celle du premier de ces faits.

6.2.2. Modalités de retour - Dispositions générales à tous les modes de retour ( retour par courrier/colis)

Les produits doivent impérativement être retournés à Greyb4ck dans un état propre à une nouvelle commercialisation (produits en parfait état accompagnés de leur emballage d'origine, accessoires, notice...) dans le délai de 14 jours suivant l'information auprès du Vendeur de sa décision de se rétracter, selon les dispositions de l'article L.221-23 du Code de la Consommation. Les retours de produits renvoyés au-delà de ce délai ne seront pas acceptés. Les produits devront en outre être accompagnés du numéro de la Commande transmis avec les produits ou figurant sur tout autre document numérique ou papier relatif à cette Commande. 

6.2.2.2 Retour par colis

L'Acheteur qui souhaite exercer son droit de rétractation légal en retournant un produit doit suivre les instructions suivantes : 
- Utiliser l'emballage d'origine pour retourner le(s) produit(s) concerné(s).
- Utiliser de préférence le bon de retour Colissimo mis à sa disposition pour faciliter le traitement de sa demande,
- Envoyer le colis ou le courrier à l'adresse suivante :

6.2.3. Frais de retour

Conformément à l'article L221-23 du Code de la Consommation français, les frais de retour des produits demeurent à la charge de l'Acheteur qui supporte les coûts directs de renvoi des produits.

Article 7 - Garantie Légales de Conformité et Garantie contre les Vices Cachés

​

Tous les produits en vente sur le Site bénéficient de la garantie légale de conformité (telle que définie aux articles L217-4 et suivants du Code de la Consommation) et de la garantie contre les vices cachés (telle que définie aux articles 1641 et suivants du Code Civil), permettant à l'Acheteur de renvoyer sans frais les produits livrés défectueux ou non conformes. 

7.1. Garantie légale de conformité

Le code de la consommation français pris en son Article L217-4 prévoit : « Le vendeur est tenu de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité. »

Selon l'Article L217-5 : Le bien est conforme au contrat :
1° S'il est propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant :
- s'il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l'acheteur sous forme d'échantillon ou de modèle ;
- s'il présente les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage ;
2° Ou s'il présente les caractéristiques définies d'un commun accord par les parties ou est propre à tout usage spécial recherché par l'acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.
 

Lorsqu’il agit en garantie légale de conformité, l’Acheteur :

• bénéficie d’un délai de deux ans à compter de la délivrance du bien pour agir ;

• peut choisir entre la réparation ou le remplacement du bien ; 

• est dispensé de rapporter la preuve de l’existence du défaut de conformité du bien durant les six mois suivant la délivrance du bien sauf pour les biens d’occasion.

• peut décider que la garantie légale de conformité s'applique indépendamment de la garantie commerciale que le vendeur a éventuellement consentie au consommateur.

• peut décider de mettre en œuvre la garantie contre les défauts cachés de la chose vendue au sens de l’article 1641 du code civil. Dans cette hypothèse, il peut choisir entre la résolution de la vente ou une réduction du prix de vente conformément à l’article 1644 du code civil.

 

7.1.2 Garantie contre les vices cachés

Le code civil français prévoit ce qui suit en termes de garantie des vices cachés :
Article 1641 du Code Civil : Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage, que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus. Article 1648 al 1er du Code Civil : L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice.


7.1.3 Exclusion de garanties

Sont exclus de garantie les produits modifiés, réparés, intégrés ou ajoutés par l'Acheteur. La garantie ne jouera pas pour les vices apparents. La garantie ne prendra pas en charge les produits du fait d’une mauvaise utilisation.

7.2 Modalités de mise en œuvre des garanties légales

Pour toute demande concernant les garanties légales, l'Acheteur doit alors contacter le Service Clients via la rubrique "Nous contacter" du Site greyb4ck.com ou par téléphone aux heures d'ouverture du service indiquées dans la rubrique "Nous contacter" du Site greyb4ck.com.
Ces dispositions ne sont pas exclusives du droit de rétraction.

7.3 Conséquence de la mise en œuvre des garanties

Dans le cadre de la garantie légale de conformité, Greyb4ck, s'engage au choix de l'Acheteur:
- Soit à remplacer le produit par un produit identique en fonction des stocks disponibles,
- Soit à rembourser le prix du produit si le remplacement d'un produit s'avérait impossible.
Dans le cadre de la garantie légale des vices cachés, Greyb4ck, selon votre choix, s'engage, après évaluation du vice :
- Soit à lui rembourser la totalité du prix du produit retourné,
- Soit à lui rembourser une partie du prix du produit si l'Acheteur décide de conserver le produit.

Article 8 - Réserve de propriété

L’ensemble des marques figuratives ou non et toutes les illustrations, images et logotypes et tout contenu figurant sur le Site greyb4ck.com sont et demeureront la propriété exclusive de Greyb4ck ou du titulaire des droits de propriété intellectuelle concerné. 

Toute reproduction totale ou partielle, modification ou utilisation de ces marques, illustrations, images et logotypes, ou tout autre contenu du Site pour quelque motif et sur quelque support que ce soit, sans accord exprès, écrit et préalable de Greyb4ck ou du titulaire des droits de propriété intellectuelle concerné est strictement interdite. Il en est de même de même pour tous droits d'auteur, dessins et modèles, brevets figurant et/ou utilisés sur le Site. 

Article 9 - Propriété intellectuelle

Greyb4ck œuvre à protéger les informations personnelles de ses clients en assurant un haut niveau de sécurité, mais l'Acheteur a également un rôle à jouer dans la protection de ses données à caractère personnel. Notamment l'Acheteur doit maintenir la sécurité de ses transactions en ligne par exemple en ne communiquant à personne son identifiant (adresse de messagerie électronique de l'Acheteur) et/ou son mot de passe et en changeant régulièrement son mot de passe. A ce titre, Greyb4ck ne peut pas être responsable de la divulgation des informations concernant l'Acheteur à tout individu ayant utilisé son identifiant (adresse de messagerie électronique de l'Acheteur) et/ou son mot de passe. 

A ce titre, l'utilisation de l'identifiant (adresse de messagerie électronique de l'Acheteur) et/ou du mot de passe de l'Acheteur vaudront preuve de son identité, et exigibilité, à la validation de la Commande, des sommes correspondantes. Greyb4ck ne pourra en aucun cas être tenu pour responsable de l'utilisation frauduleuse de ces informations. 

La fourniture du numéro de carte bancaire et la validation finale de la Commande vaudront preuve de l'acceptation de ladite Commande et vaudront exigibilité des sommes engagées par la saisie des produits figurant sur la Commande. Les registres informatisés, conservés dans les systèmes informatiques de Greyb4ck et de ses partenaires seront considérés comme des preuves des communications, des Commandes et des paiements intervenus entre les Parties.

Article 10 - Signature et preuve

11.1 Capacité

L'Acheteur, préalablement à sa Commande, déclare avoir la pleine capacité juridique, lui permettant de s'engager au titre des présentes Conditions Générales de Vente. Greyb4ck ne peut en aucun cas être tenu de vérifier la capacité juridique de ses visiteurs et des Acheteurs. En conséquence, si une personne ne disposant pas de la capacité juridique commandait des articles sur le Site greyb4ck.com, ses responsables légaux, tuteurs, curateurs, assumeraient l'entière responsabilité de cette Commande et devraient notamment en honorer le prix. 


11.2 Limitation de responsabilité

La responsabilité de Greyb4ck au titre des obligations des présentes Conditions Générales de Vente ne saurait être engagée en cas de faute de l'Acheteur, ou à la survenance d'un événement de force majeure tel que défini par les juridictions françaises ou à tout autre événement qui n'a pas été raisonnablement sous le contrôle exclusif de Greyb4ck.

Les ventes de produits de la société Greyb4ck sont soumises au droit français quelque soit le pays de résidence de l'Acheteur et le lieu de passation de la Commande. tout litige relatif a l'existence, l'interprétation, l'exécution ou la rupture du contrat conclu entre Greyb4ck et l'utilisateur ou l’acheteur, même en cas de pluralité de défendeurs, sera, à défaut d'accord amiable, de la compétence exclusive des tribunaux français compétents en application des règles édictées par le code de procédure civile français.

Following this check, greyb4ck.com reserves the right to request supporting documents concerning the Buyer's identity and/or any additional information such as a Bank Account Statement or Proof of Address. This list is not exhaustive. All Buyers have the right to access, rectify, and delete their personal data processed by greyb4ck.com under the conditions provided for by law.

greyb4ck.com uses a secure payment tool called "Stripe." Payment security relies on Buyer authentication and the confidentiality of all data. To ensure this security, Stripe uses proven cryptography techniques and complies with the various banking regulations applicable in France.

The cardholder must therefore be in possession of the telephone terminal enabling them to retrieve the received code.

This process is intended to provide enhanced protection against the use of the customer's bank card.

Article 5 - Delivery and Receipt of Orders

​

5.1 Delivery Locations

​

Products ordered by the Buyer in accordance with these Terms and Conditions will be delivered to the address indicated by the Buyer as the delivery address on the relevant Order ("Delivery Address").

greyb4ck.com offers the Buyer the following delivery options:

- to the home or to the delivery address indicated on the order,

greyb4ck.com delivers to all countries in the European Union, excluding Italy, and also delivers to Monaco. The Middle East, Africa, and Asia are not served. Purchase invoices are sent by email to the email address provided by the Buyer when registering on the greyb4ck.com Site.

​

5.2 Delivery Methods

Greyb4ck does not deliver any packages to its carrier on the following days: Saturdays, Sundays, and public holidays, as no service is provided on those days.

​

5.2.1 Delivery Methods for Metropolitan France, Corsica, and Monaco

​

5.2.1.1. Colissimo Delivery

​

The package containing the ordered and paid-for products is delivered to the Delivery Address.

​

If the mailbox at the delivery address is insufficiently large, the package will be delivered to the home and handed over either to the Buyer or the recipient of the Order, or, at the discretion of La Poste, to another person, including any person assigned to its service, living with the Buyer, specifically authorized, with power of attorney, or to an identified third party.

​

If the package cannot be delivered for the reasons mentioned above (insufficient mailbox size and/or absence of the recipient), the Buyer or the recipient of the Order will receive a delivery notice, allowing them to collect the package at the post office indicated in the delivery notice, within a period of 14 days.

​

After this period, the package will be returned to the sender. In this case, the Buyer will be refunded the amount of the Order, less delivery costs, by any means chosen by greyb4ck.com.

​

​

5.2.1.3 Delivery to a So Colissimo Collection Point

The package containing the ordered and paid products will be delivered to the So Colissimo Collection Point selected by the Buyer when placing the Order.

The Buyer of the Order will receive an email allowing them to collect the package at the Collection Point indicated in the email within a period of 15 days from receipt of the email from greyb4ck.com. Collection from a Relay Point is only possible upon presentation of the aforementioned email address and the Buyer's identity document.

 

After this period, the package will be returned to the sender. In this case, the Buyer will be refunded the amount of the Order, less delivery costs, by any means chosen by greyb4ck.com.

​

No dispute regarding the delivery itself is possible if the package appears to have been delivered, as evidenced by the Relay Point's records.

​

5.2.2 Delivery Methods Abroad

​

5.2.2.1 Delivery by Colissimo International

Delivery methods are based on the Colissimo International network and depend on local postal services. They therefore vary from one country to another.

However, a delivery slip or acknowledgment of receipt must be signed by the Buyer or the recipient of the Order upon delivery of the package and constitutes proof of delivery by greyb4ck.com and of receipt by the Buyer or the recipient of the Order of the ordered products.

​

In the event of the absence of the Buyer or the recipient of the Order, the Buyer or the recipient of the Order usually receives a delivery notice, allowing them to collect the package from the post office indicated in the delivery notice, within a period of 10 to 21 days. However, since delivery methods vary from one country to another, the Buyer is invited to regularly check the tracking of their package, via the link in the email informing the Buyer of the dispatch of their Order, to obtain information relating to the delivery of their Order.

​

If the package is not collected within 10 to 21 business days of receipt of the delivery notice (or failing the first delivery attempt by the local postal service), the package will be returned to greyb4ck.com and the Buyer will be refunded, by any means chosen by greyb4ck.com, the amount of their Order, less delivery costs.

​

No dispute regarding the delivery itself is possible if the package appears to have been delivered, as verified by the local postal service's computer tracking system.

​

5.3 Anomaly, Damage, or Damaged Package

​

5.3.1 General Provisions

The Buyer or recipient of the Order is encouraged to check the apparent condition of the package and products upon delivery. 5.3.1.1 Delivery by Colissimo

In the event of an anomaly with the package (damaged package, open package, visible or audible deterioration of the contents), the Buyer or recipient of the Order must refuse the package, have a report of theft drawn up by the post office, and report the refusal to greyb4ck.com Customer Service as soon as possible.

​

5.3.1.2 Delivery to a So Colissimo or Mondial Relay Pickup Point

If delivery is to a So Colissimo or Mondial Relay Pickup Point, do not accept the package. Opening the package precludes any recourse against So Colissimo, Mondial Relay, and greyb4ck.com. The Buyer or recipient must report the refusal to greyb4ck.com Customer Service as soon as possible.

​

5.3.1.3 Delivery by Colissimo International

Do not open the package. Please note: opening the package precludes any recourse against the local postal service, ColiPoste, and greyb4ck.com. Return the unopened package to the local post office within five business days of delivery.

File a defect report (the name varies by country).

Report the defect to greyb4ck.com Customer Service.

​

5.3.1.4 In-Store Pickup

Products collected from a physical point of sale are made available to the Buyer in the same way as if they were purchased in-store. Therefore, the products are not protected during transport, the risks of which remain the Buyer's responsibility. The products are delivered in a shopping bag of the greyb4ck.com selection. When collecting the order, a valid ID must be presented and must match the identity of the person who placed the order. If the person who placed the order is unable to collect their order, they must appoint a relative or friend, who must be in possession of a photocopy of both sides of the valid ID of the person placing the order, their own ID, and a handwritten, dated, and signed power of attorney from the principal.

​

In-store collection can only be made after receiving the email informing them that the product is available at the physical point of sale. No order may be withdrawn before receipt of this email, and for any reason whatsoever.

​

5.3.2 Procedure that must be followed in the event of a missing or damaged product inside the package without visible external damage

The Buyer or recipient of the Order must report the missing or damaged product to greyb4ck.com Customer Service. Customer Service will provide the procedure to follow with a personalized response.

​

5.4 Delivery Times

The delivery times mentioned for mainland France and Monaco apply to products in immediate availability and take into account the package preparation time.

​

- So Colissimo: 2 to 4 business days

​

Delivery times for other countries: 15 business days.

Delivery times begin upon sending the Order confirmation email.

​

If these deadlines are exceeded and not due to force majeure, the Buyer may cancel their Order under the following conditions:

- By contacting Greyb4ck customer service by any means: in the "Contact Us" section of the greyb4ck.com website or by telephone during the service opening hours indicated in the "Contact Us" section of the greyb4ck website, expressing their wishes clearly and unambiguously. In such cases, the Buyer should refuse the package if it has already been shipped.

Article 6 - Legal Right of Withdrawal

​

6.1. Exercising the Legal Right of Withdrawal

The right of withdrawal may be exercised in accordance with the provisions of Articles L.221-5, L.221-18, L221-19, L.221-23, and L.221-24 of the French Consumer Code, which sets out the terms and conditions for its implementation.

​

6.1.1. Period for exercising the legal right of withdrawal

In accordance with the provisions of Article L. 221-18 of the French Consumer Code, the Buyer has a period of 14 (fourteen) days to exercise their legal right of withdrawal without having to provide a reason.

​

In accordance with the provisions of Article L. 221-19 of the French Consumer Code and Council Regulation No. 1182/71/EEC of 3 June 1971 determining the rules applicable to periods, dates, and deadlines, the deadline begins on the day after the package containing the ordered products is received. If the deadline expires on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next business day.

 

6.1.2 Conditions for exercising the statutory right of withdrawal

In accordance with the provisions of Article L.221-21 of the French Consumer Code, the Buyer exercises their right of withdrawal by informing the Seller of their decision to withdraw by sending, before the expiry of the period provided for in Article L.221-18, the withdrawal form or any other unambiguous statement expressing their wish to withdraw.

To exercise their statutory right of withdrawal, the Buyer may, in particular, use the sample withdrawal form attached to these General Terms and Conditions of Sale and send it to the following address: 2 Rue Roumanille – 13008 Marseille, or send it by email to the following address: greyb4ck@gmail.com.

6.1.3. Products excluded from the statutory right of withdrawal

In accordance with the provisions of Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for Orders for the supply of goods that have been unsealed after delivery and cannot be returned due to the impossibility of resale.

​

Consequently, the Buyer is informed that they will not be able to exercise their right of withdrawal for products unsealed by the Buyer, the resale of which by greyb4ck.com would present risks due to the impossibility of resale.

​

These provisions apply without prejudice to the guarantees provided for in the other articles of these General Terms and Conditions, which remain fully applicable.

​

6.2. Return and Refund Terms and Conditions under the Legal Right of Withdrawal

​

6.2.1 Refund Period

Products subject to the exercise of the legal right of withdrawal will be refunded to the Buyer no later than fourteen days from the date Greyb4ck is informed of the consumer's decision to withdraw, in accordance with the conditions set out in Article L.221.24 of the French Consumer Code. However, the refund will be deferred until the Seller has recovered the said products, or until the Buyer has provided proof of shipment of the goods, whichever comes first.

6.2.2. Return Terms - General Provisions for All Return Methods (Return by Mail/Parcel)

Products must be returned to Greyb4ck in a condition suitable for resale (products in perfect condition accompanied by their original packaging, accessories, instructions, etc.) within 14 days of informing the Seller of their decision to withdraw, in accordance with the provisions of Article L.221-23 of the French Consumer Code. Returns of products sent after this period will not be accepted. Products must also be accompanied by the Order number sent with the products or appearing on any other digital or paper document relating to the Order.

6.2.2.2 Returns by Parcel

​

Buyers wishing to exercise their legal right of withdrawal by returning a product must follow these instructions:

- Use the original packaging to return the product(s) in question.

- Preferably use the Colissimo return slip provided to facilitate processing of your request.

6.2.3. Return Costs

In accordance with Article L221-23 of the French Consumer Code, the cost of returning products remains the responsibility of the Buyer, who bears the direct costs of returning the products.

Article 7 - Legal Guarantee of Conformity and Warranty against Hidden Defects

​

All products sold on the Site benefit from the legal guarantee of conformity (as defined in Articles L217-4 et seq. of the Consumer Code) and the warranty against hidden defects (as defined in Articles 1641 et seq. of the Civil Code), allowing the Buyer to return defective or non-compliant products delivered free of charge.

​

7.1. Legal Guarantee of Conformity

Article L217-4 of the French Consumer Code provides: "The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery." It is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been made its responsibility by the contract or has been carried out under its responsibility.

​

According to Article L217-5: The good conforms to the contract:

1° If it is suitable for the use usually expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model;

- if it possesses the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or its representative, particularly in advertising or labeling;

2° Or if it possesses the characteristics mutually agreed upon by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention, and accepted by the seller.

When acting under the legal guarantee of conformity, the Buyer:

​

• has a period of two years from delivery of the goods to take action;

• may choose between repair or replacement of the goods;

• is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods, except for used goods.

• may decide that the legal guarantee of conformity applies regardless of any commercial warranty that the seller may have granted to the consumer.

• may decide to implement the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, they may choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.

7.1.2 Warranty against hidden defects

The French Civil Code provides the following regarding the warranty against hidden defects:

Article 1641 of the Civil Code: The seller is bound by the warranty against hidden defects in the item sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of them. Article 1648, paragraph 1 of the Civil Code: An action resulting from latent defects must be brought by the buyer within two years of discovering the defect.

7.1.3 Exclusion of warranties

Products modified, repaired, integrated, or added by the Buyer are excluded from the warranty. The warranty does not apply to visible defects. The warranty does not cover products damaged due to misuse.

​

7.2 Terms of Implementation of Legal Guarantees

For any inquiries regarding legal guarantees, the Buyer must contact Customer Service via the "Contact Us" section of the greyb4ck.com website or by telephone during the service opening hours indicated in the "Contact Us" section of the greyb4ck.com website.

These provisions do not exclude the right of withdrawal.

7.3 Consequences of the Implementation of Guarantees

Under the legal guarantee of conformity, Greyb4ck undertakes, at the Buyer's discretion:

- Either to replace the product with an identical product depending on available stock,

- Or to refund the price of the product if a replacement product proves impossible.

Under the legal guarantee against hidden defects, Greyb4ck undertakes, at your discretion, after assessing the defect:

- Either to refund the full price of the returned product,

- Or to refund a portion of the price of the product if the Buyer decides to keep the product.

Article 8 - Retention of Title

All trademarks, whether figurative or not, and all illustrations, images, logos, and any content appearing on the greyb4ck.com Website are and will remain the exclusive property of Greyb4ck or the relevant intellectual property rights holder.

​

Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, or any other content of the Site for any reason and on any medium whatsoever, without the express, written and prior consent of Greyb4ck or the holder of the intellectual property rights concerned is strictly prohibited. The same applies to all copyrights, designs and models, patents appearing and/or used on the Site.

Article 9 - Intellectual Property

Greyb4ck strives to protect its customers' personal information by ensuring a high level of security, but the Buyer also has a role to play in protecting their personal data. In particular, the Buyer must maintain the security of their online transactions, for example, by not sharing their username (Buyer's email address) and/or password with anyone and by changing their password regularly. As such, Greyb4ck cannot be held responsible for the disclosure of information concerning the Buyer to any individual who has used their username (Buyer's email address) and/or password.

​

As such, the use of the Buyer's username (Buyer's email address) and/or password shall constitute proof of their identity and the corresponding amounts payable upon validation of the Order. Greyb4ck cannot be held responsible for the fraudulent use of this information.

​

Providing the credit card number and final validation of the Order will constitute proof of acceptance of the Order and will constitute payment of the amounts incurred by entering the products listed on the Order. The computerized records stored in the computer systems of Greyb4ck and its partners will be considered as proof of communications, Orders, and payments between the Parties.

​

Article 10 - Signature and Proof

​

Greyb4ck makes every effort to protect its customers' personal information by ensuring a high level of security. However, the Buyer must play an active role in protecting their personal data. In particular, the Buyer must maintain the security of their online transactions, for example, by not sharing their username (Buyer's email address) and/or password with anyone and by regularly changing their password. As such, Greyb4ck cannot be held responsible for the disclosure of information concerning the Buyer to any individual who has used their username (Buyer's email address) and/or password. As such, the use of the Buyer's username (Buyer's email address) and/or password will constitute proof of their identity and the corresponding amounts will be payable upon validation of the Order. Greyb4ck cannot be held responsible for the fraudulent use of this information. The provision of the credit card number and the final validation of the Order will constitute proof of acceptance of said Order and will constitute payment of the amounts committed by the entry of the products appearing on the Order.
